GENERAL TERMS & CONDITIONS

These terms and conditions affect your legal rights.  It is important that you read this agreement carefully before making a purchase. By signing this agreement or by selecting “I agree to the Terms and Conditions” you acknowledge that you have read, understood and agreed to be bound by the terms and conditions in this agreement.  If you are making a purchase on behalf of another person, you agree that you are their agent so that they will be bound by this agreement.  

 

INDOOR GOLF RANGE NZ LIMITED (NZBN: 9429048477680) (Trading as “SWEET SPOT Indoor Golf”) as the supplier of recreational services, sells all tickets and supplies all recreational services and facilities to the customer (“you”), including but not limited to: indoor golf simulation session, putting green sessions, coaching & lessons, entertainment, food & drinks, sitting area and use of the Simulator Bays and PuttView Putting Green within the SWEET SPOT Indoor Golf venue.  All use of the facilities at SWEET SPOT Indoor Golf is undertaken according to the Terms and Conditions in this agreement, the safety rules and restriction guidelines on the SWEET SPOT Indoor Golf website and the instructions given during introduction briefing. By purchasing a simulation session and/or participation in a session at SWEET SPOT Indoor Golf, you are deemed to have accepted the Terms and Conditions in this agreement with SWEET SPOT Indoor Golf. 

PARTICIPATION STATEMENT:

By participating you agree to the Terms & Conditions and Safety Rules & Restriction Guidelines below. You should be in good health to participate in physical activity and participate in accordance with these rules. It is the parents/guardians responsibility to ensure that their children adhere to these safety rules. Golfing is not recommended for guests that have neck or back problems, heart problems or have had recent surgery. If you encounter any problems or have any pre-existing medical conditions please discuss these with a staff member of SWEET SPOT Indoor Golf.

DISCLAIMER:

By agreeing to these Terms and Conditions, you acknowledge that golfing can be a dangerous pastime with inherent risks and hazards and as a consequence personal injury and sometimes death can occur and you assume and accept all such risks. SWEET SPOT Indoor Golf has taken every possible step to ensure that you have a completely safe and fun experience through the use of our Simulator Bays and Putting Greens, high quality equipment and the employment of a qualified and experienced team. However, we cannot accept any responsibility for injuries sustained due to negligence on the part of the participants. For you to enter SWEET SPOT Indoor Golf premises, we will require that you confirm that you accept responsibility for you and your party during your time in the centre.

RELEASE:

Subject to the provisions in this agreement, you release, discharge and forever hold harmless SWEET SPOT Indoor Golf, its employees, directors and agents from all liability, obligation and responsibility of any nature for death or for any losses, damages or injuries relating to or arising directly or indirectly from your engagement in the recreational activity and from your participation in any related or incidental activities.

 

This Release shall be binding on your Estate and may be pleaded by SWEET SPOT Indoor Golf as a complete bar in relation to any action, suit, claim or demand of any nature that you may bring against SWEET SPOT Indoor Golf or which may be brought on your behalf.  This Release shall extend and shall apply to all conduct of SWEET SPOT Indoor Golf including, without limitation, the circumstances where the facilities pursuant to which the recreational activity takes place were not supplied with due care and skill or not fit for purpose or because of negligence, breach of contract, statute or statutory duty by SWEET SPOT Indoor Golf. In no event shall SWEET SPOT Indoor Golf be liable for loss of profit or consequential damages, whether based on breaches of contract, warranty or otherwise. 

GENERAL GUIDELINES:

  1. Entry price includes the hire of the full bay, an introduction then a 50 minute Simulator Bay session or 25 minute Putting Green (Puttview) session.

  2. Please arrive 10 minutes prior to your booked session for processing and introduction.

  3. Parents/Guardians remain responsible for their child’s welfare at all times
    Please note: children aged 13 and under must be accompanied by a responsible adult who is required to be present during the session. Unaccompanied children will not be allowed to participate and will lose their booked session. Exception for SWEET SPOT Indoor Golf Young Golfer Development Academy Programme After School Programme attendees.
    If one parent or guardian is bringing multiple kids, some of which are not his/her own, that adult is responsible for that group.

  4. All bookings are subject to our Booking/Cancellation/Refund Policy stated in Terms and Conditions.

  5. Participants must follow the below Safety Rules and Restriction Guidelines. Failure to abide by any of the guidelines may result in cancellation of the remainder of your paid simulator time without compensation.:

GOLFERS MUST

  1. Golfers must check-in before entering the simulator bay area.

  2. Golfers must ensure golf clubs and footwear (no spikes!) are clean before entering the simulator bays.

  3. Golfers must be by him/herself in the hitting area (black turf) at all time.

  4. Golfers must be responsible for the equipment inside the simulator bays.

  5. Golfers must only swing clubs on the green hitting mat for safety reasons.

  6. Golfers must check the surroundings (monitor, other players etc.) before swinging any club to ensure no one or obstacle is within the range of swing.

  7. Golfers must ensure the shot is directed towards the hitting screen.

  8. Golfers must be aware of your backswing and follow through at all times.

  9. Golfers must follow Staff instructions, Safety Rules and Restrictions at all times.

  10. Golfers must report any accidents immediately.

  11. Golfers must be responsible for any damage or missing hired clubs and will be charged for the replacement at wholesale cost.

  12. Golfer are financially responsible for any damage caused by failure to follow the directions of the Rules and Guidelines.

IMPORTANT: NO LONG-DRIVE DRIVERS!!!

FEES, CHARGES AND TICKETS/PASSES:

All transactions are in New Zealand Dollars (GST inclusive).  Fees and charges are shown on the SWEET SPOT Indoor Golf website and at the venue and are subject to change without notice.  Booking online in advance is recommended to ensure space is available.  You are required to pay the session fee in full prior to being admitted into that session.  Tickets/passes issued remain the property of SWEET SPOT Indoor Golf and are void if tampered with. Multipasses, and Gift Cards are non-refundable and void after the 12 month expiry date.  All SWEET SPOT Indoor Golf tickets/passes are valid only for the date and time shown and may not, without the prior communication and written consent of SWEET SPOT Indoor Golf, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes either by you as the original purchaser or any subsequent bearer.

You acknowledge that despite SWEET SPOT Indoor Golf’s reasonable precautions, SWEET SPOT Indoor Golf products and services may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error or oversight.  In these circumstances, SWEET SPOT Indoor Golf reserves the right to cancel the transaction, notwithstanding that your booking has been confirmed and full payment has been made. 

BOOKING / CANCELLATION / REFUND POLICY:

At SWEET SPOT Indoor Golf, all bookings and services are non-refundable as you have agreed to our Terms & Conditions at your time of booking.

*Please note there will be NO REFUND for no-shows on the day. **Transaction Fees are 100% NON-REFUNDABLE.

SIMULATOR BAY and PUTTING GREEN BOOKINGS:

At SWEET SPOT Indoor Golf, all casual indoor golf simulation session bookings are non-refundable but can be rescheduled or hold as a credit to the last business day of that year less a $5 administration fee per every transaction request. Rescheduling is subject to availability. To reschedule, you need to contact SWEET SPOT Indoor Golf by using the CONTACT US (info@sweetspotindoorgolf.co.nz) page on our website or on 021-1432-698 giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff for a new date and time which will require confirmation by a new confirmation email from SWEET SPOT Indoor Golf.

BOOK A BAY & PUTTING GREEN (PUTTVIEW) BOOKINGS

Should you need to reschedule your session for whatever reason, we will require a minimum of 48 hour notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 48 hour notice is given and then the non-refundable policy applies.

SIMULATOR LEAGUES

Should you need to reschedule your simulator leagues for whatever reason, we will require a minimum of 7 day notice prior to the starting date of your booked Simulator League. Unfortunately, we are unable to offer any re-scheduling if less than a 7 day notice is given and then the non-refundable policy applies.

MORNING & TWILIGHT and MONTHLY SUNDAY FAMILY LEAGUE

Should you need to reschedule your league session for whatever reason, we will require a minimum of 48 hour notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 48 hour notice is given and then the non-refundable policy applies.

EXCLUSIVE HIRE / GROUP / PARTY / SCHOOL BOOKINGS:

At SWEET SPOT Indoor Golf, you are eligible to make amendments or cancellation for any corporate, exclusive, group, party or school bookings giving at least the below minimum period of prior notice. You need to contact SWEET SPOT Indoor Golf by using the CONTACT US (info@sweetspotindoorgolf.co.nz) page on our website or on 021-1432-698 giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff with the new date and time which will require confirmation by a new confirmation email from SWEET SPOT Indoor Golf.

RESCHEDULING YOUR BOOKING

Should you need to reschedule your booking for whatever reason, we will need a minimum of 7 day notice. You are entitled to reschedule less a $5 administration fee per every transaction request. Unfortunately, we are unable to offer any rescheduling if less than a 7 day notice is given and then the non-refundable policy applies.

PARTIAL CANCELLATION OF YOUR BOOKING

Should you need to partial cancel part of your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $5 administration fee per every transaction request. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given and then the non-refundable policy applies.

CANCELLATION OF YOUR BOOKING

Should you need to cancel your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $100 cancellation fee per booking. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given and then the non-refundable policy applies

AGE RESTRICTIONS:

Children aged 13 and under must be supervised by a responsible adult. The adult responsible for such children agrees to be bound by the SWEET SPOT Indoor Golf General Terms and Conditions on their behalf and will directly supervise the child at all times. 

HEALTH AND EMERGENCY TREATMENT: 

You acknowledge and are aware that the physical and mental exertion required to engage in the recreational activity and/or to participate in the activity can activate or aggravate a pre-existing physical condition, so you are required to be in good health and free from any adverse medical conditions. You are not permitted to participate in golfing if you are impaired by any medical conditions.  You should always seek medical advice if you are in doubt about your health. You agree to pay the cost of and authorise SWEET SPOT Indoor Golf to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation. 

HEALTH AND SAFETY REGULATION:

No outside food or drinks is permitted inside SWEET SPOT Indoor Golf.

Actions of Others:  You acknowledge that that there are inherent risks that may arise from the actions of other participants and/or spectators that are not condoned by SWEET SPOT Indoor Golf, but which may nevertheless still occur, which include pedestrian traffic, irresponsible, unreasonable, excessive, reckless, careless, unkind, wanton and generally objectionable behaviour whether intentional or unintentional.  

RIGHT TO REFUSE ENTRY: 

SWEET SPOT Indoor Golf holds the right to refuse entry or cancel your access to use the facility if you:

  • reasonably appear to be under the influence or in the possession of alcohol or illicit substances;

  • fail to comply with Safety Rules and Restriction Guidelines and/or fail to follow the instructions of SWEET SPOT Indoor Golf staff;

  • behave in an offensive, reckless, careless or threatening manner to other customers or staff; and

  • are reasonably deemed to be a danger to yourself, other customers or SWEET SPOT Indoor Golf staff.

CONSENT FOR VIDEO, IMAGES AND EMAIL: 

You acknowledge and give consent that, upon entering the SWEET SPOT Indoor Golf premises, you and children for whom you are responsible for may be photographed and/or videoed for security, safety and promotional purposes. By providing your email to SWEET SPOT Indoor Golf you consent to receiving promotional and advertising material from time to time.

  • I have read, understood and accepted the SWEET SPOT Indoor Golf's Safety Rules and Restriction Guidelines.

  • I affirm that my health is good and my participation in SWEET SPOT Indoor Golf activities is voluntary.
